Terms of Use

These Terms of Use ("Terms") govern your access to and use of Guavy's website, APIs, and related services (collectively, the "Services"). By using the Services, you agree to these Terms.
Overview
Guavy provides market data, news, and alerting tools for cryptocurrencies. Guavy does not provide investment, financial, legal, or tax advice; Guavy is not a broker, dealer, exchange, or investment adviser. Content is for informational purposes only and may be inaccurate, delayed, incomplete, or change without notice.
Eligibility
You must be at least 18 (or the age of majority in your jurisdiction) and have the legal capacity to enter into a contract. You may not use the Services if prohibited by applicable law, including sanctions/export restrictions.
Account Responsibilities
You're responsible for your account, device, and credentials. Keep them secure and notify us immediately of any unauthorized use. You must provide accurate information and keep it up to date.
Subscriptions, Billing, and Trials
- Auto-renewal. Paid plans are auto-renewing until you cancel. Your payment method on file is charged at purchase and renewal.
- Manage/cancel. Manage or cancel at any time through your account billing settings. To avoid renewal, cancel at least 24 hours before the period ends.
- Trials. If offered, trials convert to a paid plan unless canceled before the trial ends. Any unused portion of a trial is forfeited when you purchase.
- Pricing/changes. We may change prices or features prospectively; if required, we'll provide notice via the app or email.
- Refunds. Refund requests are handled on a case-by-case basis. Contact us at support@guavy.com.
Acceptable Use
You agree not to:
- Access or use the Services in violation of any law or regulation (including market manipulation or sanctions rules).
- Copy, scrape, harvest, or cache data at a scale or method that exceeds normal user activity or violates our technical limits.
- Circumvent paywalls, rate limits, security, or DRM; resell, redistribute, or sublicense alerts or data without our written consent.
- Reverse engineer, decompile, or create derivative works of the Services except to the extent such restriction is prohibited by law.
- Upload malware or interfere with the Services' operation or other users' access.
We may monitor for abuse and enforce these Terms.
Market Data, Insights & No-Advice Disclaimer
Signals, alerts, charts, backtests, sentiment, and other insights are informational and may contain errors or delays. Past performance is not indicative of future results. You are solely responsible for your decisions and risk. Guavy makes no warranty that any signal, alert, or data will be available, accurate, or profitable.
Third-Party Services
The Services integrate with third parties (e.g., Stripe for billing, Resend for email delivery, MongoDB Atlas for data storage, Google Analytics for website analytics, and Cloudflare for security). Your use of those services may be subject to their terms and privacy policies. Guavy is not responsible for third-party content or services.
Intellectual Property
The Services, including software, designs, logos, text, graphics, and data, are owned by Guavy or its licensors and are protected by IP laws. Subject to compliance with these Terms, Guavy grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your own use. On the self-serve plans (Sandbox, Quant, and Pro), that license is limited to your personal and internal use — including your own research and trading of your own assets. On these plans you may not: resell, redistribute, sublicense, publish, or publicly display the data; build, train, or operate any product, model, or service that makes the data (or outputs derived from it) available to third parties; or use the Services on behalf of, or for the benefit of, any other person or entity. Commercial use — including customer-facing applications, funds or accounts managed for others, agents acting on behalf of third parties, white-labeling, and redistribution — requires an Enterprise license. All rights not expressly granted are reserved.
User Content & Feedback
If you submit content or feedback, you grant Guavy a perpetual, worldwide, royalty-free license to use it to operate and improve the Services. You represent you have the rights to submit it and that it doesn't violate others' rights or laws.
Beta Features
We may release experimental or beta features. They are provided as-is, may be modified or removed, and may be less reliable than mainline features.
Availability & Changes
We may change, suspend, or discontinue any part of the Services at any time. We try to avoid downtime but do not guarantee uninterrupted or error-free operation.
Disclaimers
The Services are provided "as is" and "as available." To the maximum extent permitted by law, Guavy disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
Limitation of Liability
To the maximum extent permitted by law, Guavy and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to the Services or these Terms, even if advised of the possibility. Our total liability for all claims relating to the Services will not exceed the amounts you paid to Guavy (if any) in the 12 months before the event giving rise to the claim.
Some jurisdictions don't allow certain exclusions/limits; in those cases, the above applies to the fullest extent permitted.
Termination
You may stop using the Services at any time. We may suspend or terminate your access immediately if you breach these Terms, create risk, or cause harm. Upon termination, the sections on Market Data, Third-Party Services, Intellectual Property, User Content, Disclaimers, Limitation of Liability, and Governing Law survive.
Changes to Terms
We may update these Terms from time to time. If we make material changes, we'll notify you (e.g., in-app notice or email). Your continued use after the effective date constitutes acceptance.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-law principles, and the courts located in Vancouver, British Columbia will have exclusive jurisdiction.
